Converge 2022 Terms & Conditions

Converge 2022 (“Converge” or the “Event”) will take place at the Fairmont Austin (the “Venue”) in Austin, TX from November 14 – 17, 2022. This registration agreement (the “Agreement”) is made by and between Tanium Inc. (“Tanium”) and the registrant’s company/organization. Except where prohibited by law, the registration form has been completed by an employee of the registering company/organization (the “Registrant” or “Attendee”) who is authorized by the company/organization to accept the terms of registration. This Agreement includes and incorporates by reference Tanium’s Privacy Policy (available at https://www.tanium.com/privacy-policy and Tanium's Terms of Use (available at https://www.tanium.com/terms-of-use). Submission of an online registration constitutes acceptance of these terms and conditions. Your registration acceptance is at Tanium's sole discretion.

Cancellation policy 

If circumstances or policies in your organization change and the Registrant can no longer attend Converge, their registration may be canceled by providing written notice to Tanium by emailing [email protected].

The Converge refund policy is as follows: 

  • Cancellation on or before Sunday, October 2, 2022: Full refund of registration fee, less a $50.00 processing fee. 
  • Cancellation or refund request received on or after October 3, 2022: Partial refund at Tanium's sole discretion.  

If applicable, Tanium will refund the Registrant's registration fees within sixty (60) days of receipt of the cancellation notice. No registration refunds will be provided other than through the process described here.

Registration cancellations do not automatically cancel hotel and/or travel arrangements made by the Registrant. Registrants are responsible for making, managing, and, if necessary, canceling their own hotel and travel reservations. If the Registrant's hotel reservation was booked through the Converge website, reservation and cancellation details can be obtained by emailing

. Tanium is not responsible for any damages, direct or indirect, resulting from any cancellations related to registration(s), impermissible substitution(s), hotel reservations, or travel arrangements.

Government employees
Converge is a large conference for Tanium users with diverse views and interests. Tanium therefore believes that Converge qualifies as a Widely Attended Gathering ("WAG") as described in 5 C.F.R. 2635 204. Before registering and/or attending Converge, government Registrants should discuss their attendance with their ethics officer(s) and obtain written authorization for the following:

  • Register and attend Converge for free or at a discounted rate
  • Receive instructional materials from Tanium and/or Event sponsors prior and during the Event
  • Partake in complimentary group meal and refreshment functions, including alcoholic beverages, at the Event
  • Reserve a hotel room at the Fairmont Austin at a discounted government rate

Attendees should comply with their own and employer's policies regarding the acceptance of such items. Tanium can provide additional information regarding Converge if needed for such processes.

By registering and/or attending Converge, Registrant attests to having obtained all necessary authorizations and approvals from their employer and agrees to comply with all laws and regulations set forth.

Registrant must also comply, for the entire duration of Converge, with any applicable rules and regulations imposed by their employing agency, including those rules and regulations relating to the acceptance and disclosure of gifts and gratuities.

 

Substitution policy 

A substitution of registrant within the same company/organization is allowed on or before October 31, 2022.  Registration substitution requests must be submitted via email to [email protected]. Substitutions will occur by canceling the original Registrant's  registration and having the new Registrant register for the Event. Any Early Bird or discounted pricing in effect for the canceled Registrant will be honored for the replacement Registrant. The replacement Registrant must be from the same company/organization as the canceled Registrant. A maximum of one (1) substitution per original registration is allowed.

 

Visa requirements and invitation letters

It is the Registrant’s sole responsibility to be aware of and manage any visa requirements related to their travel to Converge. If the Registrant requires an entry visa, they must allow sufficient time for the visa application process to be carried out. Requests for Converge invitation letters for visa purposes should be emailed to [email protected]. Tanium will not contact embassies and consulates on the behalf of the Registrant. In the event that a visa request is denied, the Registrant should contact [email protected] to request a cancellation and/or refund.
 

Health & safety

The health and safety of all Attendees is paramount to Tanium. By attending the Event in-person, Registrants acknowledge and agree to the below health certification, risk assumption, and waiver related to coronavirus:


Health certification

By agreeing and attending the event, you certify that in the 14 days prior to the event you: (1) have not had a fever, chills, cough, shortness of breath or difficulty breathing, fatigue, muscle or body aches, headache, new loss of taste or smell, sore throat, congestion or runny nose, nausea or vomiting or diarrhea; or (2) have not been in close contact with a person who you believe has tested positive for Covid or who has experienced the foregoing symptoms (excluding people who are symptom free and who have had Covid in the past three months and recovered or those who are fully vaccinated).


Risk assumption

By agreeing and attending the event, (1) you acknowledge that Covid is highly contagious and is known to result in injury, illness, disability or even death; (2) you voluntarily assume the risk that you may be exposed to, or infected by, Covid during (or in route to or from) the event, from the acts, errors, omissions or negligence of yourself or others; (3) you accept sole responsibility for any personal injury, illness, disability or death, including any related damages, losses, claims, liabilities or expenses (“claims”) of any kind that you may sustain in connection with your attendance at the event, either at the event or in route to or from the event; and (4) you authorize Tanium Inc. and Enterprise Events Group (EEG), their affiliates, employees, directors, agents, vendors and representatives to process the personal information you provide in compliance with applicable laws as necessary to conform with the rules and regulations of applicable health authorities and to follow onsite health and safety plans and guidelines, including documenting health screens and certifications.
 

Waiver

By agreeing and attending the event, you hereby release, covenant not to sue, discharge, and hold harmless Tanium Inc. and Enterprise Events Group (EEG), their affiliates, employees, directors, agents, vendors and representatives, from and against any potential claims, including any damages related to Covid. You acknowledge and agree that this release includes any claims based on the actions, errors, omissions or negligence of Tanium and Enterprise Events Group (EEG) and their affiliates, employees, directors, agents, vendors and representatives, relating to Covid.
 

Age limitation 

All attendees must be at least 18 years of age to attend Converge and must be at least 21 years of age to attend the Tanium-hosted Converge evening events. Requests for any exceptions to this term must be submitted to Tanium in writing by emailing [email protected]. Whether any exception is granted is in the sole discretion of Tanium.

 

Photo ID

Registrants will be required to provide a photo of themselves (“Security Headshot”) for identification purposes prior to gaining entry to the Event. This Security Headshot will be printed on the name badge that the Registrant collects onsite. Registrants who have not uploaded a permissible Security Headshot prior to arriving onsite will be asked to take a photo for their Security Headshot at the Registration Desk prior to picking up their name badge. Registrants will also be required to present a government- or company-issued photo id prior to collecting their Converge name badge and materials at the Event.
 

Guests

Due to capacity and security concerns, no guests of Registrants are permitted to attend any Converge sessions, functions, or events. Registrants who do not abide by this term will have their name badge revoked and be asked to leave the Event.
 

Badge control and tracking

Converge-issued name badges are the sole property of Tanium and must be surrendered upon request to Converge and/or Tanium representatives. Registrants must have their Converge-issued name badge prominently displayed while at Converge and any designated off-site functions.

Tanium will employ RFID tracking technology to gain a better understanding of how Attendees spend their time at the Event and improve the event experience provided to Attendees. This RFID technology will be embedded in the Converge-issued name badges that Attendees receive onsite at the Event. The data collected using this technology will be used to verify and track activity including but not limited to the following:

  • Keynote and session attendance
  • Converge function attendance
  • Sponsor booth and session visitation
  • General Attendee activity

Tanium may also utilize other generalized approaches to monitor and track attendance that do not require specific badge information (such as sign-in sheets). Any personal information resulting from the utilization of RFID tracking technology and/or generalized approaches is collected in Tanium’s legitimate interests and is subject to Tanium’s Privacy Policy found at https://www.tanium.com/privacy-policy/

Attendees will be asked to have their name badge scanned by a Converge event staff member or Tanium representative upon entry to Converge sessions and/or functions. False certification of an individual as a company’s representative, misuse of a name badge, or any other method or device used to assist with giving unauthorized personnel admittance to the Event will be just cause for expelling the Attendee from the Event and/or banning them from any current or future Tanium-hosted events. If such action takes place, Tanium is released from any obligation to refund or reimburse the expelled Attendee or their company/organization for any fees paid or costs incurred by the Attendee or their company/organization related to the current or future events they are banned from. The Attendee and Attendee’s company/organization furthermore waive any rights or claims for damages arising out of the enforcement of this rule.

 

Photography, audio and video recording

Converge is held in a public space, therefore Tanium does not prohibit participants, news organizations or other companies/organizations or media outlets from photographing, video recording, or audiotaping Converge sessions or activities. By attending Converge, Attendee gives their express consent to Tanium and its agents to photograph and record the event and activities related to Converge in visual and audio media. By registering and attending the Event, the Attendee hereby irrevocably agrees and consents that Tanium has the right to record, transcribe, modify, perform, reproduce, display, distribute and transmit in any form and for any purpose their name, voice, picture, photograph, portrait and other reproductions of their likeness (collectively, your “Image”) at Converge in connection with any advertising or promotional content and materials, or for any other lawful purpose including posts to public websites. However, Tanium is not obligated to make any use of the Attendee’s Image, name or likeness, or exercise any of the rights granted to it. Attendee also agrees that their Image may appear in photos of Converge made available to them, other Converge attendees, and the public, and any such parties may retain and distribute those photos.

 

Admittance

In its sole discretion and without refund, Tanium reserves the right to refuse admittance to or expel from Converge anyone that it determines is behaving in a manner that could be disruptive to Converge or any other attendee.

 

Privacy statement

Tanium will handle Registrant and Attendee personal information that is collected during registration, onsite, and in virtual spaces in accordance with Tanium’s Privacy Policy found at https://www.tanium.com/privacy-policy/.
 

Venue and accommodations

Attendees are required to comply with the rules and regulations governing the applicable venue and/or accommodation. Attendees shall insure and keep insured any property they bring onto the venue and/or accommodation, and any such property is brought onto, or left, at the venue and/or accommodation at their own risk.
 

Force majeure

Tanium shall not be held responsible for any delay or failure in performance of its obligations hereunder to the extent such delay or failure is caused by fire, flood, strike, civil, governmental or military authority, acts of God, acts of terrorism, acts of war, epidemics, pandemics, the availability of the technology required to host or access Converge or other similar causes beyond its reasonable control and without the fault or negligence of Tanium or its subcontractors. For one or more of such reasons, Tanium may postpone, reschedule or cancel the event without liability on the part of Tanium. In the event Converge cannot be held or is postponed pursuant to this section, Tanium shall not be liable to attendee for any damages, costs, or losses incurred, such as transportation costs, accommodations costs, or financial losses. Tanium will review refund and/or fee transfer requests, submitted in writing as set forth below, for approval on a situational basis.

Assumption of risk and release of liability

You understand that participation in Converge carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. Unless otherwise prohibited by law, you hereby agree to release and hold harmless Tanium, its employees, vendors, partners, agents and contractors from all alleged and/or actual liability, claims, actions, lawsuits, damages and losses of any kind, including attorney’s fees, which arise out of or result from your attendance at and participation in Converge and ancillary activities, including but not limited to property damage and personal injuries, illness, death or other physical loss, whether foreseeable or not.

 

Agreement

The views expressed by any Converge Attendee or speaker are not necessarily those of Tanium. All Converge attendees and speakers other than Tanium employees are solely responsible for the content of any and all individual or corporation presentations, marketing collateral, advertising, and online web content.

This Agreement and all claims arising hereunder will be governed by and construed in accordance with the laws of the State of Washington excluding the conflict of laws principles of the forum. Any judicial action with respect to Converge or this Agreement shall be filed exclusively in the federal or state courts located in King County, Washington. If any provision of this Agreement is for any reason found to be unenforceable, the remainder of the Agreement will continue in full force and effect to the fullest extent permitted by law. The Agreement and their incorporated documents constitute the complete and exclusive understanding and agreement of the parties and supersedes all prior understandings and agreements, whether written or oral, with respect to the subject matter hereof.
