Contest Rules 

 

The intent and spirit of Survey Contest at Tanium Converge 2021 (the “Contest”) is to encourage participants to provide their feedback after attending the event.  The Survey Contest is a Promotional Contest of Chance.  These are the official rules and regulations (the “Contest Rules”) that govern how the Contest operates.  

BY SIGNING IN OR OTHERWISE REGISTERING FOR OR PARTICIPATING IN THE CONTEST, YOU ARE REPRESENTING THAT YOU HAVE AUTHORITY TO ENTER INTO THE CONTEST. IF YOU DO NOT AGREE WITH THE TERMS AND CONDITIONS CONTAINED HEREIN, DO NOT OPT-IN TO PARTICIPATE IN THE CONTEST.  

NO PURCHASE OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE THE CHANCES OF WINNING.   

ODDS OF WINNING WILL DEPEND ON THE TOTAL NUMBER OF SURVEY SUBMISSIONS (1 PER PERSON). VOID WHERE PROHIBITED BY LAW OR WHERE REGISTRATION OR BONDING IS REQUIRED. SUBJECT TO ALL FEDERAL, STATE AND LOCAL LAWS.   

 

You hereby expressly agree as follows:  
 

1. DEFINITIONS:  

“Employer” means the entity by which a Participant is employed and/or representing in their attendance of the Event. 

“Event” means Tanium’s annual user and partner conference known as “Converge 2021” currently scheduled to be held virtually on November 16 through November 18, 2021. 

“Contest” refers to Survey Contest that takes place after the Converge 2021 event, a promotional contest of chance. 

“Tanium” and “Sponsor” each refer to Tanium Inc., 3550 Carillon Point, Kirkland, WA. 

“Participant” or “You” means a person who enters the Contest, on his or her own behalf and/or on behalf of his or her Employer.  

“Prize” or “Prizes” refers to the items identified in Section 6 of these Contest Rules that Winners are eligible to receive.  

“Registration” or “Registrant” means the enrollment of an individual via the Converge 2021 event website, as a Participant in the Contest. For purposes of clarity, Participants will be deemed to have agreed to and accepted these Contest Rules upon choosing to opt-in during their log in process on the event day(s). 

“Winner” or “Winners” means the person(s) identified by the Judging Criteria to be eligible for Prize(s), as identified in Section 4 of these Contest Rules. 
 

2.  HOW TO ENTER AND CONTEST REQUIREMENTS:  

Individuals seeking to enroll as Participants in the Contest will have the ability to opt-in or opt-out of participating in the Contest. To opt-in and enter the Contest, enter your name and email address at the bottom of the survey.  The entry period for the Contest begins on November 19, 2021 at 8:00 AM PST and ends on November 28, at 11:59 PM PST (“Entry Period”). All entries must be received during the Entry Period to be eligible to enter the Contest or win a prize.  Limit of one (1) entry per participant. 
 

3. CONTEST PARTICIPATION ELIGIBILITY REQUIREMENTS: 

 
Each Participant must be a registered attendee of the Event. Participants must have personally participated in the Contest and must be a confirmed Attendee at the time Winners are selected and prizes are awarded.  

Participants must not be government employees, including all federal, state, county, city or municipal government employees and K-12 employees, and not be ineligible to participate under all applicable laws and regulations. 

Participants must not be employees, contractors, vendors, officers or directors of Tanium, Inc. or any of its subsidiaries and affiliated companies, nor their immediate family members nor those living in their households. 
 

4. WINNERS:  

Ten (10) winners of the Contest will be selected at random based from eligible entries on the number of people that have entered to win by November 28, at 11:59 PM PST. On November 29, 10 winners will be selected to receive a Prize as described in Section 6 of these Contest Rules. 
 

5. NOTIFICATION:  

Winners will be contacted via email beginning on November 29, 2021. Participant understands and agrees that the Judging Criteria will determine the Winners and that such determination shall be final and binding in all respects. Acceptance of any Prize constitutes permission to use a Winner’s name, Employer information and logo, biographical information of participating Employer representatives, likeness of participating Employer representatives, in each case without further compensation, except where prohibited by law and as otherwise provided herein.   
 

6. PRIZES:  

  • Each of the ten (10) winners will receive a Yeti Tumbler ($40.00 USD retail value each) 

Prize(s) are not transferable; no substitutions or cash equivalents are allowed. When applicable, Winners will be required to execute and return any applicable tax forms within three (3) days of notification of winnings. If a Winner fails to return any such form by the deadlines indicated, prize(s) may be forfeited. TAXES, IF ANY, RELATED TO THE PRIZE ARE THE RESPONSIBILITY OF THE WINNER. No responsibility or liability is assumed by Sponsor for damages, losses or injury resulting from acceptance or use of any Prize. All other expenses and costs not expressly listed above are the Winner’s sole responsibility.  
 

7. OTHER POLICIES AFFECTING YOUR ELIGIBILITY:  

It is each Participant’s sole responsibility to review, understand and abide by his or her Employer’s policies regarding eligibility to participate in the Contest and receive any prizes. GOVERNMENT EMPLOYEES, INCLUDING ALL FEDERAL, STATE, COUNTY, CITY OR MUNICIPAL GOVERNMENT EMPLOYEES AND K-12 EMPLOYEES ARE NOT ELIGIBLE TO PARTICIPATE OR WIN A PRIZE. If a government employee chooses to participate and become eligible for a prize, then he or she may only claim a prize if we obtain a written opinion from his or her agency ethics office approving the receipt of the prize. If a Participant is found to be in violation of his or her Employer’s policies, then he or she will be disqualified from participating in the Contest and being awarded or retaining any prize. Sponsor disclaims any and all liability or responsibility for disputes arising between a Participant and his or her Employer.  
 

8. GENERAL RULES:  

By participating in this Promotional Contest of Chance Contest, each Participant agrees to be bound by these Contest Rules and the decisions of Sponsor. Sponsor is not responsible for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user or by any of the equipment or programming associated with or utilized in this Contest or by any human error which may occur in the processing of entries during this Contest. Notwithstanding anything to the contrary in the Contest Rules, Sponsor reserves the right in its sole discretion to reject, cancel or revoke any participation by an individual Participant for any reason, including without limitation to disqualify any Participant that it believes may be tampering or attempting to tamper with the Contest process or the operation of the Contest, or violates the Contest Rules. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such Participant to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Contest Rules shall not constitute a waiver of that provision. Sponsor reserves the right, to cancel, terminate, modify or suspend the Contest as deemed necessary or appropriate by Sponsor in its sole reasonable discretion, including, but not limited to reasons involving tampering, unauthorized intervention, fraud, technical failures or any other problems beyond the control of Sponsor. Sponsor and each of its respective affiliates, officers, directors, agents, and employees will have no liability or responsibility for any claim arising in connection with participation in this Contest or the prize awarded. Each Participant assumes all liability for any injury or damage caused, or claimed to be caused, by participation in this Contest or use or redemption of any prize.  
 

9. RELEASE/LIMITATIONS OF LIABILITY:  

PARTICIPANT HEREBY HOLDS SPONSOR AND ITS RESPECTIVE AFFILIATES, PRIZE SUPPLIERS, AND ADVERTISING AND CONTEST AGENCIES, AND EACH OF THE FOREGOING’S RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, SHAREHOLDERS AND AGENTS (COLLECTIVELY "RELEASEES") HARMLESS FROM AND AGAINST ANY CLAIM ARISING FROM THE CONTEST. RELEASEES ARE NOT RESPONSIBLE FOR LOST, LATE, DAMAGED, MISDIRECTED, ILLEGIBLE, INCOMPLETE, OR MUTILATED ENTRIES, OR FOR ANY COMPUTER, ONLINE, TELEPHONE OR TECHNICAL MALFUNCTIONS, DELAYS OR HUMAN ERRORS THAT OCCUR IN THE PROCESSING, TRANSMISSION OR RECEIPT OF ENTRIES, OR IF FOR ANY REASON, THE CONTEST IS NOT CAPABLE OF BEING CONDUCTED AS PLANNED, INCLUDING BUT NOT LIMITED TO INFECTION BY COMPUTER VIRUSES, BUGS, TAMPERING, UNAUTHORIZED INTERVENTION, FRAUD, TECHNICAL FAILURES, OR OTHER CAUSES BEYOND THE CONTROL OF SPONSOR. SPONSOR RESERVES THE RIGHT AT ITS SOLE DISCRETION TO CANCEL, TERMINATE, MODIFY OR SUSPEND THE CONTEST. SPONSOR IS NOT RESPONSIBLE FOR INCORRECT OR INACCURATE ENTRY INFORMATION WHETHER CAUSED BY INTERNET USERS OR BY ANY OF THE EQUIPMENT OR PROGRAMMING ASSOCIATED WITH OR UTILIZED IN THE CONTEST OR BY ANY TECHNICAL OR HUMAN ERROR THAT MAY OCCUR IN THE PROCESSING OF THE ENTRIES IN THE CONTEST.  

IN NO EVENT WILL SPONSOR BE LIABLE TO PARTICIPANT FOR SPECIAL, INDIRECT, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, FOR LOST PROFITS, LOST REVENUES OR OTHER INCIDENTAL DAMAGES BASED ON ANY THEORY, EVEN IF SPONSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL SPONSOR’S TOTAL LIABILITY TO PARTICIPANT UNDER THESE OFFICIAL CONTEST RULES EXCEED $50 USD.  
 

10. MISCELLANEOUS  

Any disputes in connection with this Contest will be resolved in the appropriate courts in King County, WA, exclusively, and subject to the laws of the state of Washington, without regard to choice of law provisions. Should there be a conflict between the laws of the state of Washington and any other laws, the conflict will be resolved in favor of the laws of the state of Washington. Either party may terminate these Contest Rules at any time and for any reason, with or without cause, and without penalty, and without compensation of any kind, effective after giving written notice of termination to the other party. Participant will bear all of its own expenses in connection with the performance of these Contest Rules and his/her participation in the Contest and will not be entitled to reimbursement of any such expenses by Tanium. The provisions of Sections 4 through 11 shall survive any termination or expiration of these Contest Rules.
