Government Employees

Converge is a large conference of Tanium’s users with diverse views and interests. Tanium believes Converge may qualify as a Widely Attended Gathering (“WAG”) as described in 5 C.F.R. 2635.204. Government employees should first discuss attendance with their ethics officer and obtain written authorization to attend Converge at a free or discounted rate and to receive instructional materials, and any other complimentary items, at this event. Attendees should comply with their own and their employer’s policies regarding the acceptance of such items. Tanium can provide additional information regarding Converge if needed for such process. By attending Converge, you represent that you have obtained all necessary authorizations from your employer, and that you agree to comply with all laws and regulations.

You must also comply, for the entire duration of Converge, with all applicable rules and regulations imposed by your employing agency, including those rules and regulations relating to the acceptance and disclosure of gifts and gratuities.

Age Limitation

All attendees must be at least 18 years of age to attend Converge. Requests for any exception to this term must be submitted to Tanium in writing as set forth below. Whether the exception is granted is in the sole discretion of Tanium.

Identity Verification

We will be using your email address to identify you and verify that you are registered to attend Converge. You will be required to use a business email address to register for our conference. We reserve the right to follow up with you to verify your identity.

Badge Control, Tracking, and Information Sharing

Converge-issued badges may be used during the conference and are the sole property of Tanium and may be rescinded as necessary by Converge and/or Tanium representatives.

To verify and track keynote and session attendance and general activity at the event, provide a record of attendance, and continue to improve the event experience we provide to our attendees through internal research, Tanium will utilize attendance tracking technology to better understand how attendees spend time at the event. For clarity, to the extent that we collect any personal data regarding an attendee's attendance or participation in the event for our use, we do so in reliance on our legitimate interests and subject to our Privacy Policy found at https://www.tanium.com/privacy-policy/.

False certification of an individual as a company’s representative, misuse of a badge, or any other method or device used to assist unauthorized personnel to gain admittance to the event, will be just cause for expelling the attendee from Converge and/or banning them from current and future years of Converge without obligation on the part of Tanium for refund of any fees. The attendee and attendee’s company, if applicable, waive any rights or claims for damages arising out of the enforcement of this rule.

You acknowledge that if your badge is scanned by or for any sponsor or other third party with a badge scanner (each, an “Event Sponsor”), or if you attend a virtual event hosted by and Event Sponsor, then that Event Sponsor may have access to a third-party report that includes such attendance and participation information, and also certain of your registration information. Tanium is not responsible for the privacy practices of any Event Sponsor or other third party. Please contact the Event Sponsor or third party to learn more about its practices with respect to any information that it collects.

If you do not wish to permit the uses and disclosures of information described in this section, do not allow any Event Sponsor or third party to scan your badge or otherwise attend an Event Sponsor session.

Photography, Audio, and Video Recording

Converge is held in a public forum, therefore Tanium does not prohibit participants, news organizations or other companies from photographing or video or audiotaping some Converge activities. By attending Converge whether in person or virtually, you give your express consent to Tanium and its agents to photograph, record (both video and audio), webcast, podcast, or otherwise transmit the event and activities related to Converge, including you, in any format or media now known or hereafter developed. You hereby irrevocably agree and consent that Tanium has the right to record, transcribe, modify, perform, reproduce, display, distribute and transmit in any form and for any purpose your name, voice, picture, photograph, portrait and other reproductions of your likeness (collectively, your “Image”) at Converge in connection with any advertising or promotional content and materials, or for any other lawful purpose including by posting on public websites. However, Tanium is not obligated to make any use of your Image, name or likeness, or exercise any of the rights granted to it. You also agree that your Image may appear in photos of Converge made available to you, other attendees of Converge, and the public, and any such parties may retain and distribute those photos.

In its sole discretion and without refund, Tanium reserves the right to refuse admittance to or expel from Converge anyone that it determines is behaving in a manner that could be disruptive to Converge or any other attendee.

Privacy Statement

Tanium will handle your personal information received during your registration in accordance with Tanium’s Privacy Policy found at https://www.tanium.com/privacy-policy/.

Force Majeure

Tanium shall not be held responsible for any delay or failure in performance of its obligations hereunder to the extent such delay or failure is caused by fire, flood, strike, civil, governmental or military authority, acts of God, acts of terrorism, acts of war, epidemics, pandemics, the availability of the technology required to host or access Converge or other similar causes beyond its reasonable control and without the fault or negligence of Tanium or its subcontractors. For one or more of such reasons, Tanium may postpone, reschedule or cancel the event without liability on the part of Tanium. In the event Converge cannot be held or is postponed pursuant to this section, Tanium shall not be liable to attendee for any damages, costs, or losses incurred, such as transportation costs, accommodations costs, or financial losses. Tanium will review refund and/or fee transfer requests, submitted in writing as set forth below, for approval on a situational basis.

Any notices to Tanium relating to Converge can be addressed to: [email protected].

Assumption of Risk and Release of Liability

You understand that participation in Converge carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. Unless otherwise prohibited by law, you hereby agree to release and hold harmless Tanium, its employees, vendors, partners, agents and contractors from all alleged and/or actual liability, claims, actions, lawsuits, damages and losses of any kind, including attorney’s fees, which arise out of or result from your registration, attendance at, and participation in Converge and ancillary activities, including but not limited to property damage and personal injuries, illness, death or other physical loss, whether foreseeable or not.

The views expressed by any Converge attendee or speaker are not necessarily those of Tanium. All Converge attendees or speakers other than Tanium employees are solely responsible for the content of any, and all, individual or corporation presentations, marketing collateral, advertising and online web content. Given the public nature of the event, content provided or presented by non-Tanium participants should not include confidential information.

This Agreement and all claims arising hereunder will be governed by and construed in accordance with the laws of the State of Washington excluding the conflict of laws principles of the forum. Any judicial action with respect to Converge or this Agreement shall be filed exclusively in the federal or state courts located in King County, Washington. If any provision of this Agreement is for any reason found to be unenforceable, the remainder of the Agreement will continue in full force and effect to the fullest extent permitted by law. The Agreement and their incorporated documents constitute the complete and exclusive understanding and agreement of the parties and supersedes all prior understandings and agreements, whether written or oral, with respect to the subject matter hereof.
